QAxelerate Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and QA24by7.com ("Company," "we," "us," or "our") regarding your use of QAxelerate ("App," "Service," or "Application"), an AI agent for Atlassian JIRA that generates comprehensive test cases.

By installing, accessing, or using QAxelerate, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. About QAxelerate

QAxelerate is an AI-powered application that integrates with Atlassian JIRA to automatically generate comprehensive test cases for software development issues. The Service analyzes your JIRA issues and creates relevant test cases as sub-tasks within your existing JIRA workflow.

3. Eligibility and Account Requirements

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3.2 JIRA Integration

QAxelerate operates entirely through Atlassian JIRA authentication. You must have a valid JIRA account and appropriate permissions to use the Service. We do not create or maintain separate user accounts.

3.3 Required Permissions

The App requires specific JIRA permissions to function properly, including the ability to read issues and create sub-tasks. By using the Service, you consent to granting these permissions.

4. Service Description and Availability

4.1 Core Functionality

QAxelerate provides AI-generated test case recommendations based on your JIRA issues. The Service processes your issue data in real-time to generate relevant test scenarios, which you can then create as JIRA sub-tasks.

4.2 AI Technology

Our Service utilizes third-party large language model (LLM) services to generate test cases. While we strive for accuracy, AI-generated content may not always be perfect or suitable for all use cases.

4.3 Service Availability

We aim to provide reliable service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

5. Pricing and Payment Terms

5.1 Free Period

QAxelerate is currently available free of charge for a limited time. We reserve the right to introduce pricing at any time with reasonable notice to users.

5.2 Future Pricing

When pricing is implemented, we will provide at least 30 days' notice before any charges begin. Pricing tiers and payment terms will be published on our website and within the Atlassian Marketplace.

5.3 No Usage Restrictions (Current)

During the free period, there are no restrictions on the number of test cases you can generate, subject to fair use principles.

6. Data Privacy and Security

6.1 Data Processing

QAxelerate processes your JIRA data in real-time to generate test cases. We do not store your JIRA data on our servers or any servers outside of Atlassian's infrastructure.

6.2 Data Storage

All your data remains stored exclusively on Atlassian servers. We do not maintain copies of your JIRA issues, test cases, or other project data.

6.3 Third-Party AI Services

We use third-party AI services to generate test cases. Your issue data may be temporarily processed by these services but is not stored by them beyond the processing session.

6.4 Privacy Policy

Our data handling practices are detailed in our Privacy Policy, which is incorporated by reference into these Terms.

7. User Responsibilities and Acceptable Use

7.1 Compliance

You agree to use the Service in compliance with all applicable laws, regulations, and Atlassian's terms of service.

7.2 Appropriate Use

You will not use the Service to:

• Generate test cases for illegal, harmful, or malicious software
• Process confidential information that violates third-party rights
• Attempt to reverse engineer or compromise the Service
• Use the Service in ways that could harm our systems or other users

7.3 Content Responsibility

You are responsible for the accuracy and appropriateness of the JIRA issues you process through QAxelerate and the test cases you choose to implement.

8. Intellectual Property Rights

8.1 Service Ownership

QAxelerate, including its algorithms, user interface, and documentation, is owned by QA24by7.com and protected by intellectual property laws.

8.2 Your Content

You retain ownership of your JIRA data and any test cases you create. By using the Service, you grant us a limited license to process your data solely for providing the Service.

8.3 Generated Content

Test cases generated by QAxelerate are provided to you without any ownership claims from us. However, you acknowledge that similar test cases may be generated for other users.

9. Disclaimers and Limitations

9.1 Service Warranty

The Service is provided "as is" without warranties of any kind. We do not guarantee that AI-generated test cases will be suitable for your specific needs or free from errors.

9.2 Professional Judgment

QAxelerate is a tool to assist in test case generation. You should always review and validate generated test cases using your professional judgment before implementation.

9.3 Limitation of Liability

To the maximum extent permitted by law, QA24by7.com shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.

9.4 Maximum Liability

Our total liability to you for all claims related to the Service shall not exceed the amount you have paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless QA24by7.com from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

11. Updates and Modifications

11.1 Service Updates

We may update QAxelerate from time to time to improve functionality, security, or compliance. Updates will be deployed through the Atlassian Marketplace.

11.2 Terms Updates

We reserve the right to modify these Terms at any time. We will notify users of material changes through the Service or email. Continued use after changes constitutes acceptance of the updated Terms.

12. Termination

12.1 Termination by You

You may stop using QAxelerate at any time by uninstalling it from your JIRA instance.

12.2 Termination by Us

We may suspend or terminate your access to the Service if you violate these Terms or engage in harmful activities.

12.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Any data processing will stop, but data already in your JIRA instance remains unaffected.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Hyderabad, India.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and QA24by7.com regarding the Service.

14.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

14.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.4 Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations under these Terms without restriction.
